Description:

The National Environmental Policy Act (NEPA) requires federal agencies to evaluate the potential environmental impacts of major actions before making a decision to proceed.  NEPA was enacted by Congress in 1969 and signed into law by President Nixon on January 1, 1970.  After initially issuing guidelines, the Council on Environmental Quality (CEQ) issued regulations binding on all federal agencies in 1978.  The regulations guide federal agencies in implementing NEPA requirements, including the preparation of environmental review documents and ensuring public involvement in agency decision-making.  Several agencies have also published their own regulations under NEPA.  

This webinar will discuss how requirements under NEPA have evolved over the years, both through regulatory actions and through judicial interpretations as a result of legal actions brought against federal agencies over alleged deficiencies in their NEPA processes.  The webinar will also discuss recent and ongoing initiatives at the federal level to review and streamline NEPA requirements and their implementation.  A question and answer session will take place following the presentation.

Speaker Bio:

Lucinda Low Swartz, Esq. operates a small, woman-owned business specializing in all aspects of compliance with NEPA.  Since 2008, she has focused on developing sound NEPA compliance strategies for both federal agencies preparing NEPA documents and private industry seeking federal approvals.

Prior to starting her own business, Lucy was a NEPA program/project manager for 15 years, leading teams in the preparation of environmental impact statements (EIS) and environmental assessments (EA) for federal agencies and in the preparation of NEPA-related environmental reports for private industry. She previously served as the Deputy General Counsel at the Council on Environmental Quality (CEQ), providing authoritative guidance to federal agencies on all aspects of NEPA compliance.

Lucy has 35 years of experience in environmental law and regulation. She has been an instructor for Duke University’s School of the Environment and the American Law Institute-American Bar Association, and is the co-author of the annual Recent NEPA Cases presented at the National Association of Environmental Professionals’ conference.
